How to spend your life

Dr. Hovind’s Travel update,

It is 5 am Feb. 12, 06 (Darwin’s Birthday) and I just finished reading some of my huge pile of letters and articles that get sent to me every day. I often sleep hard for 4-5 hours then wake up in the night to work a few hours, read and pray before going back to sleep for another hour or so. I know it is a strange schedule but the phone never rings and I never get interrupted so I get lots done! I’m staying in a beautiful home in the snow covered country in Tennessee where I have been preaching for the last two days. I head home this afternoon. Yea! Then on to Texas Wednesday to tape with Dr. Baugh on TBN.

Three days ago was my 37th spiritual birthday. As I was talking with the Lord tonight about all the great needs in the world I said, “Lord, there is only one of me! And sometimes that is too many!” I know that I often get in the way of God doing His work. At the seminar earlier today (or yesterday-what do you call it in the middle of the night?) I was talking with one of the dozens of kids that always swarm about me before and after each service. I asked him what he wanted to be when he grew up. I wonder how many times I have asked kids that question.

Then I thought, what do I want to be when I grow up? Many years ago I asked one of my science students what I should be when I grow up. She said, “You don’t need to worry about that Mr. Hovind. That will never happen to you!”

I will probably always be a kid but what should I be if I ever grow up? I could easily spend my life reading and learning. I love to read! I could also spend my life teaching and preaching. I do that over 900 times every year now. I could spend my life building and developing Dinosaur Adventure Land. I love to build and think up new ways to teach spiritual truths using science and God’s creation. I could spend my life answering letters, calls and questions. I love to help people understand God’s Word and appreciate His creation! I could spend my life debating evolutionists at universities. I have done that 100 times now and really love it! The more hostile the environment (like at UC Berkeley twice now) the better I like it! Well over 3,000 professors have refused to debate me. I can understand there reluctance. Would you want to defend the idea that we all came from a rock? I love debating evolutionists to help the poor students they try to brainwash!

I could easily spend my life with my family. My three children and their spouses all live around me and work in our ministry. We love each other and get along marvelously. My four grandchildren (ages 3 and under with anoth on the way) are even more fun than their parents! I really love reading them books, taking naps with them, teaching them things, watching their excited faces as we go “feed the critters” every night that I am home. We have lots of “critters” like turtles, snakes, hamsters, chinchillas, peacocks, a dove, lizards etc at DAL. I wish I had grown up in a place like DAL! You should come visit this amazing place!

I could spend my life touring the world. I love to travel and see new places. I have been to all 50 states and 37 counties with 4 more coming this year! (Come join me for the 9 day Holy Land cruise this November- see the web site for details) I could also spend my life riding my Suzuki 650 scooter. Of the 80 plus motorcycles I have owned since I was 12 this one is the best! If you have never had motorcycle fever you will not understand!

I could spend my life complaining. My back hurts nearly every moment of my life from 3 whiplash accidents 30 years ago. My son in law has very serious cancer and is in pain every day as well. My wife has had debilitating pain every day for 6 years now from her bruised tail bone. There is always an endless list of things to fix in one of the 20 buildings our ministry owns or one of the many vehicles and machines we use. There is never enough money to do all the things we want to do to expand our outreach for the Lord. There are now nearly 2,000 anti-Hovind web sites where dozens of lies circulate about me. Even a few fellow creationists misrepresent me on their sites. I could spend my life defending myself against their lies.

I could spend my life thinking of the past and regretting all the missed opportunities. If only I had …… I could spend my life worrying about the future. The New World Order is fast approaching and “perilous times” (2 Timothy 3:1) are coming soon for the world.

It is now 6 am and I think I will go back to sleep for an hour. Then I will get up to go preach about creation on Darwin’s birthday, make airplanes for the kids, tell corny jokes, make some child feel important, build the faith of some college student struggling with evolution and win someone to Christ. I think I will just keep doing what I have been doing for 37 years now- try to be a servant of the Lord Jesus Christ and obey Him day by day. I think I will spend my life doing that. It is really rewarding! You should try it.

It amazes me how many Christians think Bro. Hovind should just pay for the permit. How many of those same Christians would pay for a permit to attend church this (and every) Sunday? How many of them would pay for a permit to read their Bible tonight (or any time)? I wonder how many of the media who have written critically about DAL would pay for a permit to write those articles? How many of us would pay for a permit to speak on the phone? How many would pay for a permit to post an item on the internet critical of Bro. Hovind? Why don’t those who oppose him have to pay for permits to do that?

You say, “Those things are Constitutional rights! We shouldn’t have to pay for a permit to practice our Constitutional rights!”

Exactly. Bro. Hovind’s ministries are protected by Constitutional provisions on religious liberty, free speech, and private property. Not only that, they are in obedience to God and we are to obey God rather than men. Teno

Camps?

Several of our staff went with me today to look at a few camps that are available. We feel this would be a great way to expand our ministry outreach. What a big decision! We feel we have the right message, the right staff and this is the right time in history to agressively share the creation message. Please pray that God will guide us and provide the funding if it is His will for us to do this. If you know of any other camps that may be available please let us know.
Our DAL ministry is still going well in spite of a few of our buildings being closed down. [See previous blogs] Come see for yourself! This is a great time of year to visit Pensacola. We have had hundreds of visitors and have seen many lives changed. The battle over the buildings is proceeding on several fronts and we look for resolution soon so keep praying and writing to the people who can fix this even if they don’t want to listen yet.

Open letter to Escambia County Commissioner Whitehead,

Render to Caesar?

Dear Escambia County Commissioner Whitehead,

I watched the channel 10 news yesterday where you said that the Church ministry at Dinosaur Adventure Land must “render to Caesar the things that are Caesar’s, and right now Caesar demands a building permit. If they don’t get one, we may have to tear the buildings down.”

It always amazes me how people like you quote half a verse out of context to prove their point. The rest of the verse is never quoted. Matthew 22:21 “They say unto him, Caesar’s. Then saith he unto them, Render therefore unto Caesar the things which are Caesar’s; and unto God the things that are God’s.” The Church is not Caesars! Also Mark 12:17, Luke 20:25.

There are a few things you seem to forget:

  1. The Church ministry you are referring to is not a 501-c-3 corporation of the state.
  2. No churches in the county got permits of any kind for hundreds of years.
  3. They have invited you out many times to inspect for safety and health yet you don’t come.
  4. They have had licensed engineers and electricians inspect the buildings.
  5. They have been open for 5 years without problem
  6. They stood through three hurricanes with no damage while your own building was damaged badly.
  7. Dictators down through history have “won” battles with those who oppose them. Hitler “won” over the Jews. Stalin “won” over the Christians in Russia, the catholic church “won” over the millions of Christians they killed, OJ “won” his court battle. Don’t think because you “won” in court that proves you are right.

Have you prayed about what you are doing? Please do not hide behind a court order or directions from the attorney. Please don’t tell me you are just obeying orders, Hitler’s men said the same thing at their trial. You claim to be a Christian and I believe you are but please just answer these two questions, Have you prayed about what you are doing, and do you feel God has led you in your decision?

When I read the Pensacola News Journal article April 7, 06 “Park could face extinction” by William Rabb I couldn’t help but wonder, “Are these people morons or just desperate to sell papers?” The recent court ruling to close a few of our buildings over the permit issue (which has been going on for 5 years) does not close our ministry or even our Dinosaur Adventure Land. We still have lots of visitors coming every day. Remedies at Law, the managers of the ministry, are working with the courts and county to reopen the buildings and I still travel every week doing seminars on creation, our bookstore is still open, we still ship out thousands of books and videos every week, I still do my daily radio program on www.truthradio.com from 4:30-6 pm CST and souls are still being saved and lives changed. We are no where near “extinction.” They must be desperate or dense!

Another rumor is that I want to be a law unto myself and not get the county building permits. First, this is a ministry wide decision and Glen Stoll, the manager, makes those calls. I travel too much to spend much time on this. Second, the county has inspected the buildings twice, as well as two state certified engineers and two state certified electricians. The issue has never been one of safety or health. We have filled out the papers and given the county the information they requested 2 ½ years ago and never got a response, other than locking the buildings. We have repeatedly asked them what they want from us and we get no response.

Escambia County Commission Chairman Mike Whitehead did exactly what Satan did in Matthew 4:6 by quoting half a verse. At the hearing last Thursday Mr. Whitehead said “Render unto Caesar the things which are Caesar’s. And right now Caesar demands a building permit.” He does not understand the rest of the verse. Matthew 22:21 “They say unto him, Caesar’s. Then saith he unto them, Render therefore unto Caesar the things which are Caesar’s; and unto God the things that are God’s.”

The Church is not Caesar’s! We are willing to be good neighbors, let them inspect and make suggestions, we have invited them many times to do this. The only issue is control.

Before you believe and repeat things about our ministry in violation of Exodus 20:16 “Thou shalt not bear false witness against thy neighbour.” Call in to our radio program and ask any questions you want. In America you still get to face your accusers and are innocent until proven guilty. At least it is supposed to be that way.

Why can’t they just submit?

“Why can’t they just submit?” That is what Nebuchadnezzar was thinking as he ordered the Hebrew children thrown into the furnace. A few minutes later he got his answer as he understood there was a higher power able to stop his little furnace or render it useless. The men in the fire were not rebels or troublemakers. They were loyal top officers in the kingdom. They just served a bigger God. That’s why they couldn’t submit.

Why can’t they just submit? That’s what the Romans were wondering as they rounded up Christians by the thousands and crucified them for disobeying the Roman laws about claiming there was an authority over Caesar. How dare they insult “his royal highness” so! Don’t they know that Caesar is God? We’ll teach them! Why can’t they just submit?”

Why can’t they just submit? That’s what the Inquisition officers said as they tortured and murdered millions of Christians who dared to claim the Pope was a sinner like everyone else or that Marry was not a “perpetual virgin” or that the bread did not actually become the body of Jesus so the priest controlled God as he held the wafer. Don’t they know that our law says they must believe this? Why can’t they just submit?”

That’s what the kings of Europe wondered as they hounded the Pilgrims for daring to teach that baptism was only for believers. “Don’t they know we have met and decided that infant baptism is all that is needed and to re-baptize is against the law? How many of these Anna-Baptists will we have to kill and confiscate their lands until they understand? Why can’t they just submit?”

Why can’t they just submit? That’s what King George thought as he sent his army to snuff out the “rebellion” among the colonies who dared to ask that they be represented in the decision making process. “It is only a 1% tax on the tea. Just pay the tax and shut up! Why can’t they just submit?”

Why can’t they just submit? That’s what the elected officials in Culpepper, Virginia said as they whipped 12 Baptist pastors to death in 1775 for refusing to take a license to preach in their county. Why can’t they just submit? (See the story on drdino.com/patrick)

Why can’t they just submit? That’s what communist dictators said for 70 years as they jailed, tortured, killed or exiled millions of Christians in China and Russia who did not obey the state laws about only meeting in “state approved” churches where sermons were pre-approved and political dissent was silenced by force. “Don’t these people know we have the guns and will kill them if they disobey? Why can’t they just submit?”

“Why can’t they just submit?” That is what Building inspector Don Mayo, Attorney Allison Rogers, Attorney Janet Lander, George Touart, Commissioners Kevin White, Tom Banjanin, Marie Young, Bill Dickson and Mike Whitehead are asking themselves right now. “Don’t these people know the courts have ruled, the commission has voted, the inspectors have decided? They must get our permission to operate a Church ministry in this county. We decide if they can have a church ministry on that property and we decide if they build their buildings to worship God in the correct way. We decide who is allowed to worship God here and where they can do it. People like Apostle Paul, Patrick Henry, Shadrach or John Bunyon are not welcome here. Why can’t they just submit?”

So… Why can’t the Church ministry at 29 Cummings Road in Pensacola just submit? I can’t explain it to them. I’ve tried but they will not or cannot listen. Maybe someone else can explain it to them. Maybe God will have to explain it to them! [Job 38:1 style?] We don’t want to cause problems. We don’t want to build anything unsafe or pollute the ground or bother our neighbors. We have begged them to come tell us what they don’t like about our buildings but they won’t tell us. I fear that this county is at the crossroads and their decisions in the next few weeks or months may result in God’s blessing or judgment. Deut. 11:26.

When people are given a badge and a gun or a black robe, does it always make them think they are God?

Proverbs 30:21 “For three things the earth is disquieted, and for four which it cannot bear: For a servant when he reigneth;” “Don’t they realize there is a higher power named God? Why can’t they (the county) just submit to God?”

Dr. Hovind says I can send in my ideas for his blog once in a while. I’ll write more later but I think these people need your prayers, calls, letters and visits (if you can’t get them at the office you may catch them at home) to have God change their heart and stop persecuting the ministry (see Dr. Hovind’s previous blogs)

Keep in mind these people below started this fight, can end it and have not been helping solve the problem at all. If they seem irritated when you call, good! They have hurt God’s man and God’s Church and they should be flooded with calls and letters. Make em do right! Roll Tide!

If I had not seen it myself I would not have believed it! I thought the lady was going to blow a gasket! Well, let’s start at the beginning. For those who have followed the story of the permit battle between our ministry and the county for the last 5 years, this will make more sense.

Today, Glen Stoll, Bruce Craig (both managers of our ministry) and I went to the Escambia County Commissioners offices to try to talk with them about resolving the conflict peacefully. All five commissioners were gone, as well as most secretaries but the two that were there told us that the county attorney, Janet Landers had instructed them to not talk with us, we could only talk with her about the case. Janet Landers was in a meeting at the time so… we went up to her office to ask her secretary when we could get an appointment.

As we were talking with her an extremely irate woman came out of a room down the hall and said, (very loudly) “You need to get out of this building immediately!” I was shocked, stunned and surprised at this outburst so I looked around to see who she was talking to. When she repeated it I said, “Are you talking to us?” She said, “Yes, you must leave this building now or I will call security.” I said, “What for? We are not causing any problems. We just came to make an appointment with Janet Landers.” She said, “I am Janet Landers and I am ordering you to leave this building!” I said, “Ma’am, I believe this is a public building and we just came to talk with you. What have we done wrong?” As she came over menacingly and held the door open I thought she was going to push us outside. I had never met her before and my first impression will take a while to overcome!

Understanding that Proverbs 22:24 “Make no friendship with an angry man; and with a furious man thou shalt not go:” probably applies to women also, I felt led of the Lord to leave. We went downstairs to get the county charter only to discover that Escambia County does not have a charter-so what exactly is their legal right to exist based on? As we were asking the clerk a few questions I noticed two Escambia County Deputies walking in the door at the end of the hall like they were looking for someone. As I was walking out to drive home for my radio program, one of the secretaries from upstairs came franticly running up to the police officers and said, “They are over there!” Pointing at the room we were in. I waved and said, “It’s OK ma’am, we are not hurting anybody.”

Imagine! Being arrested for trespassing in a public building for just asking questions! What a strange county. None of us were arrested but it felt like the Soviet Union for a few tense moments there.
As I drove back and even now, seven hours later, I cannot figure out what would trigger such a violent reaction from Janet Landers. The county started this battle against the Church five years ago. We have tried to be nice in every way possible. (Romans 12:18) We dropped all law suits against them, met with them several times, sent lots of letters and invited them out to inspect many times, yet the situation seems to be worse not better.

Here are my thoughts so far.

1. The county is hiding something they don’t want uncovered. Four of the last five commissioners were arrested (on non-related issues) several months after they voted to persecute us. (This new group of commissioners and lawyers going after us need to read Ps. 105:15 quickly!)

2. Someone in high places in the county hates God’s Kingdom on earth. (nothing new there!)

3. They fear we will sue them for all the countless violations they have committed like: A. none of them having an oath of office as required by law when they started attacking our Church and the law saying they cannot get paid until they have this oath on file. (Imagine if they all had to pay back everything they have gotten from the county for all those years!) See US Constitution- Article 6 Clause 3 and Florida State Constitution, Article 2 SECTION 5.b and Florida Statute 876.05 (2) “Said oath shall be filed with the records of the governing official or employing governmental agency prior to the approval of any voucher for the payment of salary, expenses, or other compensation.” 876.06-9 show the nasty things that should be done to the ones who took the money (and the ones who paid it out) for this one! Or B. them not having the proper parties served when the buildings were ordered closed by force or C. or D. or E … We have quite a list to call upon if need be.

4. Maybe they are worried that the courts farther up the food chain (outside this county or state) will not be part of their “good ol boys club” and decide to clean up the cesspool we seem to have stepped in.

We don’t want to fight these people. We want to build God’s Kingdom by winning souls and influencing them to live for Him. All the kingdoms of this world (including the little Escambia County kingdom) will be carried away like chaff one day (see Daniel 2:35) when Christ sets up His Kingdom. That’s the one I want to work for!

Please pray that they will leave us alone, reverse their orders, drop their charges, pay the damages they have caused, hook up our utilities and come visit the greatest creation ministry on earth (in our humble, unbiased opinion). Based on what I saw today I would say the Lord is working on them!

There is an open to the public meeting of the commissioners every 1st and 3rd Thursday from 4:30- ???. Anyone can speak their mind. Please attend this week if you can and show your support for the Lord’s work and please, keep praying for God to work on these people. They need to be getting thousands of calls, letters and emails from God fearing people. Read Esther 4:4. (I just noticed today’s date is 4-4!) And above all, pray for God to get their attention!

April 3- Religious Freedoms Restoration Act

What an awesome funeral for my son-in-law, Paul! Hundreds came to share what his life and testimony ment to them. I flew in Sunday morning after a great Sat. night meeting at Oak Grove High School in MO. I shared a quick history history of how my daughter and Paul met, then they played an incredible video of Paul’s life put together by my son Eric. Paul’s dad brought the message. That must be the hardest thing for a man to do! The entire service is soon to be available for those who are interested. There is a fund in Paul’s name to help people adopt children. If you make a donation in any amount and request the funeral service we will send it to you.

The county battle is still going strong. We never wanted this battle. We just want to serve God and be left alone. There is a long history of conflict between God’s people and secular authority over the Lordship of Jesus. It seems it will never end. If you would like to help, the county commissioners can use lots of “encouragement” to solve this problem that they created.

For those following the 5 year conflict between Escambia County and the Church we thought it would be good to spell out, What does Dinosaur Adventure Land (DAL) want from the county and who can give it to them?

For nearly 2000 years it has been the sincerely held religious conviction of Christians that Jesus, not Caesar, is the head of the church. Colossians 1:18 “And he is the head of the body, the church: who is the beginning, the firstborn from the dead; that in all things he might have the preeminence.”

Since Jesus founded it, the Lord’s church has also attempted to stay separate from entanglement with government. This has led to great conflict and persecution of the Church by those who think Caesar is lord over all. See Foxes Book of Martyrs. Conflicts between the Church and government officials are recorded in 21 out of 28 chapters in the book of Acts. Most of the early settlers of this county fled here in order to have religious freedom from the state controlled churches in Europe. The founding fathers made the “separation of church and state” doctrine very clear in scores of their writings over 230 years ago. They taught that the state has no jurisdiction over the Lord’s church.

In addition to the clear commands of God’s Word and Article 1 of the US Constitution, Florida Statue Chapter 761, the Religious Freedom Restoration Act of 1998 (RFRA) clearly tells us that “The government shall not substantially burden a person’s exercise of religion,” 761.03 “”Exercise of religion” means an act or refusal to act that is substantially motivated by a religious belief,” 761.02 (see below)

The law says a Church can act or not act based on our religious convictions. In the fall of 2000 we built a small metal building to hold ministry services in and to teach and train people about the biblical account of creation. Our pastor did not ask the county for “permission” to build on the Lord’s property as this would be an admission that the Church is subject to Caesar.

On March 29, 2001 two Escambia County building inspectors came unannounced and uninvited and trespassed on the clearly marked Church property to issue a citation. Soon thereafter the county commissioners voted to fund the legal battle that ensued and continues today. The county has spent hundreds of thousands of dollars so far and still, no end is in sight.

We understand that in the last 100 years many churches have become “incorporated” as 501 c-3 organizations, which makes them creatures of the state, and therefore subject to permits. Our ministry is not one of those and this is the distinction many people in the county are missing.

Millions of Christians in the early centuries faced torture and death rather than submit the Lord’s church to Caesar. These martyrs were not lawless people looking to be defiant of God ordained governments and neither are we. We answer to a much higher authority, that of the Creator of the universe.

We pay to have our buildings engineered and inspected by professionals to insure the safety of those we minister to. We understand the importance of this. We are even willing to pay the county inspectors to come inspect them. Our buildings are safe in all aspects that the county may have concerns over. Obviously there are hundreds of buildings standing in the county today that did not get Escambia County’s permits, such as those on the Navy base, State of Florida lands or those buildings built before the inspections department was created in the 70’s.

We are a peace loving people who simply wish to serve the Lord. We have sincerely held religious convictions against the church being taxed (permit fees) as well as asking others for permission to do what God has called us to do. Once jurisdiction is granted in one area, where does it stop? Those who live under communist control know that it does not! The Amish across the country, including Florida, object to (and do not obtain) building permits for similar religious reasons and Disneyland in Florida never gets county permits. Escambia County Commissioners have taken an oath to uphold the constitution where this principle of separation is enshrined in the first amendment. We feel sure that they all know the value of having churches and ministries training people in our county to love and obey the Lord. Surely this is much cheaper that the jail system we all support for those who do not obey the Lord’s commands. Ministries like ours are an asset to the county.

We know that our little ministry on 6 acres is not of great concern to some but we think God cares and is watching closely. The current commission has the power to resolve this ongoing conflict today as well as prevent future problems and expenses for both our ministry and this county.

The only people who stand to gain from prolonging this conflict are the attorneys who get paid by the hour and love this stuff! Our ministry fears that this struggle (which may have to go all the way to the Supreme Court) is sure to bring much negative publicity for our county. We would love to see this resolved peacefully so we can devote more time to preaching God’s Word. All our ministry wants to do is serve the Lord and influence others to do the same. We want to live peaceably with all men as commanded by the Lord and be a blessing to this community.

The solution is quite simple as we see it. It seems to us that the prudent thing for this commission to do is to vote to incorporate RFRA into the local building codes and end the conflict now.

This board of commissioners needs to require their inspectors to abide by existing Florida law (RFRA) or vote to incorporate the Religious Freedoms Restoration Act into the building code of Escambia County as other counties in Florida are doing even now. This action would resolve this current dispute with the Church ministry at 29 Cummings Road as well as prevent future challenges, which are sure to come as RFRA becomes more well known.

We feel the section below or something similar, would help the county building code incorporate RFRA. (This was proposed to the commission several years ago with no reaction. Since it is now election year they may be listening better.)

Statement of Finding by the Escambia County Commission, Escambia

The Escambia County Board of County Commissioners acknowledges the lawful existence of, and our intention to comply with the Florida Statue Chapter 761, the Religious Freedom Restoration Act of 1998 (RFRA). We further find that the county can be spared countless legal challenges to its building, zoning and development regulations by taking the prudent action of incorporating RFRA into our own county building code and related ordinances. We recognize that by statute RFRA already applies to the FLORIDA BUILDING CODE and that our action makes clear our desire to comply with RFRA/Florida Statute Chapter 761.

County Ordinance Sec. ## – ##. Compliance with Chapter 761.

NOW THEREFORE BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF ESCAMBIA COUNTY, FLORIDA

“Enforcement of this ordinance will be in strict compliance with the provisions of Florida Statue Chapter 761, the Religious Freedom Restoration Act of 1998 (RFRA). The Building Department, Code Enforcement Department, County Administrator, and any other such county officials or departments as may regulate, enforce, and/or administer the provisions of the unified FLORIDA BUILDING CODE ACT OF 1998 (in effect statewide March 1, 2002), are hereby authorized and directed to adhere to the provisions of Chapter 761.

Department administrators are to direct their staff to use the least restrictive means available to satisfy any compelling governmental interest in furtherance of the county’s health, safety and welfare objectives as set forth in this ordinance. Such authority includes making such accommodations as may reasonably be necessary, (including waiving technical requirements of the ordinance), to comply with the RFRA so long as any accommodation does not compromise any compelling interest in protecting health, safety and welfare the county may have.”

After voting the above ordinance into law we would like this board and/or the building department to do the following:

  1. Notify Judge Michael Allen that our ministry has met the requirements of the law and a conflict no longer exists and his order to close the buildings should be withdrawn and our bond returned.
  2. Notify the utility companies that they should hook up our utilities.
  3. Vote to pay some of the costs we have incurred over the last five years defending our ministry in court.
  4. Come visit our unique ministry and bring your families.

CHAPTER 761

FLORIDA RELIGIOUS FREEDOM (RFRA)

761.01 Short title.

761.02 Definitions.

761.03 Free exercise of religion protected.

761.04 Attorney’s fees and costs.

761.05 Applicability; construction.

761.01 Short title.–This act may be cited as the “Religious Freedom Restoration Act of 1998.”

761.02 Definitions.–As used in this act:

(1) “Government” or “state” includes any branch, department, agency, instrumentality, or official or other person acting under color of law of the state, a county, special district, municipality, or any other subdivision of the state.

(2) “Demonstrates” means to meet the burden of going forward with the evidence and of persuasion.

(3) “Exercise of religion” means an act or refusal to act that is substantially motivated by a religious belief, whether or not the religious exercise is compulsory or central to a larger system of religious belief.

761.03 Free exercise of religion protected.–

(1) The government shall not substantially burden a person’s exercise of religion, even if the burden results from a rule of general applicability, except that government may substantially burden a person’s exercise of religion only if it demonstrates that application of the burden to the person:

(a) Is in furtherance of a compelling governmental interest; and

(b) Is the least restrictive means of furthering that compelling governmental interest.

(2) A person whose religious exercise has been burdened in violation of this section may assert that violation as a claim or defense in a judicial proceeding and obtain appropriate relief.

761.04 Attorney’s fees and costs.–The prevailing plaintiff in any action or proceeding to enforce a provision of this act is entitled to reasonable attorney’s fees and costs to be paid by the government.

761.05 Applicability; construction.–

(1) This act applies to all state law, and the implementation of that law, whether statutory or otherwise, and whether adopted before or after the enactment of this act.

(2) State law adopted after the date of the enactment of this act is subject to this act unless such law explicitly excludes such application by reference to this act.

(3) Nothing in this act shall be construed to authorize the government to burden any religious belief.

(4) Nothing in this act shall be construed to circumvent the provisions of chapter 893.

(5) Nothing in this act shall be construed to affect, interpret, or in any way address that portion of s.3, Art. I of the State Constitution prohibiting laws respecting the establishment of religion.

(6) Nothing in this act shall create any rights by an employee against an employer if the employer is not a governmental agency.

(7) Nothing in this act shall be construed to affect, interpret, or in any way address that portion of s. 3, Art. I of the State Constitution and the First Amendment to the Constitution of the United States respecting the establishment of religion. This act shall not be construed to permit any practice prohibited by those provisions.

The Mission of the building inspections department:

“To safeguard the health, safety, and welfare of Escambia County residents, businesses, and visitors by conducting plan checking and inspection services to ensure the integrity of all new structures and major improvements to existing structures built in the unincorporated area of the County, to ensure all residential and commercial construction is in compliance with State and local building requirements, and to facilitate completion of new development applications and provide for the issuance of building permits within the unincorporated area of the County.”

Note: A Church ministry is not a “residence” nor “commercial” nor a “business.” The Church ministry at 29 Cummings has consistently challenged the jurisdiction of the inspections department and has yet to receive a response to this challenge. When challenged, jurisdiction must first be established. The county has never done this.

The inspectors probably honestly feel bound by the law to close our ministry. The commissioners probably feel the same way. This proposed solution solves it for everyone. Patrick Herny watched Baptist preachers get whipped to death for refusing to take a license to preach in Virginia. See www.drdino.com and search “Patrick” for the story. John Bunyon pastored a church of 1,000 in England when they passed a law that pastors must get a license to preach. He said God told me to preach and I don’t need your permission. He spent 15 years in jail and wrote “Pilgrim’s Progress.” I don’t know if our situation is the same but it seems to be. The county has closed our DAL buildings by force and many people are upset!

What is happening?

Why are the DAL Museum and Science Center closed?

Dinosaur Adventure Land began in 2001 as a part of the Church ministry known as Creation Science Evangelism (CSE). CSE has been working to fulfill the commands of Christ in evangelizing and teaching His Word especially in the area of creation, evolution and dinosaurs since 1989.

The buildings are temporarily closed due to a long standing dispute over building permits. When the buildings were built they were inspected by certified electricians and engineers but the Church felt it was a tax on the Church to pay for a building permit. The entire saga is on www.richardsayshome.com. The county is shutting DAL down because they do not approve of our ministry.

On March 23, 2006, Circuit Judge Michael G. Allen ordered the buildings closed after a 5 year dispute even though the proper parties were never served and the mediation settlement proposal offered by the Church 4 months ago has never been answered. The church ministry has consistently taken the position that the head of the church is Jesus Christ and for the church to pay what amounts to a tax for a building permit is in violation of the Bible and the constitutions of both Florida and the United States.

Rick Lee, in charge of planning and zoning, seems to be determined to stop our ministry. Several have said he is a homosexual with a special hatred for Christian ministries but this may or may not be true. Assume he is an honest individual trying to do his job.

Chief Building inspector Don Mayo and Escambia County Assistant Attorney Allison Perdue Rogers have been asking the court to close down DAL and bulldoze the Creation Museum and Science Center buildings since they opened. The issue has never been one of health or safety. The buildings in question have been open without incident for 5 years, have been inspected by qualified electricians and engineers, have withstood three hurricanes with no damage and have had 60,000 visitors from all 50 states and 70 foreign countries with no complaints, incidents or problems.

Nearly everyone who comes for a visit loves this place and tells their friends to come. The county inspections department has been invited many times to come inspect the buildings and offer any suggestions or advice on issues of concern regarding health or safety. They even obtained an inspection warrant and did come 2 years ago and have reported no problems. The entire issue is one of control over the Lord’s Church. The Church ministry has worked with the county over the years in every way possible to have the county recognize their sincerely held religious conviction but the county will not accommodate them in any way. They seem to have tunnel vision.

What you can do:

The Escambia County Commissioners or Administrator George Touart have the power to stop this madness in 3 seconds with a simple vote as can be seen on www.richardsayshome.com. Download the file “Urgent-Help needed” to get their numbers and addresses. Every letter and call helps. Everyone concerned should be pounding their doors down with complains, calls and letters until this is settled. These “public servants” respond to this like they always have. Mark 12:12 “And they sought to lay hold on him, but feared the people: for they knew that he had spoken the parable against them: and they left him, and went their way.” They are elected officials who fear the people.

This will be an awesome lesson on how government works. You can incorporate the history of separation of church and state. You may also want to teach your kids about how petitions work in influencing politicians. Each family can do their own petition and collect signatures of those who want the county to accommodate the convictions of the church.

Chief Building Inspector Don Mayo can also end this in 3 seconds by issuing a permit and certificate of occupancy in his own name or the name of the county and filing it in their files. He will tell you he cannot but that is not so. He will say Allison Rogers, the assistant county attorney, tells him what he must do. Her Boss is Janice Landers, the head attorney, and all three work for the commissioners who can order them to issue a temporary (or permanent) certificate of occupancy. Any of those groups can fix this. Home school families can do another “civics” project where they learn about how inspections work, the history of the inspections department, which buildings in the county do they not inspect (Federal, State, Indian, foreign embassies, and should be non-501-c-3 churches) while they attempt to influence them to leave CSE and DAL alone. If enough people use the “continual coming” approach they will respond.

Rick Lee, in charge of planning and zoning, needs to have home school families camping on his desk while they do a “civics” project where they learn why some areas need to be “zoned” for a church. In the Soviet Union they have great freedom of religion laws but no property was zoned where they could be exercised. What a subtle way to shut down God’s work! In America it has always been true that Churches are exceptions and do not need to “ask” a secular authority for a place to fulfill the commands of Christ.

The County attorney Allison Rogers or her boss Janice Landers can stop this by simply dropping the case or by asking the judge to suspend his order until further notice. Home school families can do a “civics” project where they learn why some cases are prosecuted and some are not while they attempt to influence them to leave CSE and DAL alone.

Sheriff Ron McNesby can simply refuse to help shut down the Lord’s Church. Hitler’s men should have refused his orders. George Bush told the Iraqi soldiers to refuse any orders to set oil wells on fire. It is unlikely that the sheriff will do this. Home school families can do a “civics” project where they learn about how sheriffs decide which cases to pursue. Learn whether all orders are obeyed and judges orders enforced without question (Hitler) while they attempt to influence them to leave CSE and DAL alone.

Judge Michael G. Allen can stop this in 3 seconds by rescinding his order pending further clarification. There were many problems with the way it was handled. The proper parties were never identified or notified, the jurisdictional challenges have never been answered and the order is very vague. There are many buildings on the property that have never been in question yet the order seems to allow the county to close down everything. The order should be stayed for clarification. The court ordered mediation is still not finished in the parallel case.

DAL’s Options,

  1. Fast and pray for God to intervene and change hearts.
  2. Move the DAL ministry to a new county w/clear agreement about issues.
  3. Close down DAL.
  4. Get permits.
  5. Sell ministry to new entity to get permits.
  6. Sue in court for church rights and take it to Supreme Court if need be.
  7. Start political pressure on commissioners, boycott Escambia County, letters, emails, pickets, etc.

Any of these people in government can stop this if they would have the courage to do so.

Go visit them unannounced, follow up w/calls, emails, letters, more visits. Encourage other to do the same. Look for sympathetic people we can further work on. Glen Stoll and Bruce Craig are coming next Tuesday to stay as long as it takes to resolve this. They are the managers of the ministry.

Possible questions to ask them:

“Have you read all the stuff on www.richardsayshome.com about this?”

“What can be done to accommodate the concerns of the Church?”

“Would you support a resolution or county ordinance allowing for freedom of religion in Escambia County?”

“Would you introduce such legislation to the next board of commissioners meeting?” If not, why not?

“What is REFRA that Richard talks about on his web site?—- can it be voted into the building code?” “Would you introduce legislation to do this at the next meeting?”

“What is RELUPA that Richard talks about on his web site? —- can it be voted into the building code?” “Would you introduce legislation to do this?” How can this be done?

“The Florida legislature voted years ago to allow Disney to be their own entity and not get permits from the county. It is called the Reedy Creek Development Act. Have you read this? How can DAL get something similar in Escambia County?”

“Don Mayo feels he must force the Church to submit. Are you Don Mayo’s boss?” “Who is?” “Can you tell him to issue a permit and certificate of occupancy without making the Church violate their convictions?”

Did you see the movie “Bug’s Life”? The ants were all carrying their grain along the path when a leaf fell across the path. They panicked and could not figure out what to do until a leader ant came to get them out of their rut. The county is like that in this issue. They need to find a way around the leaf. It is really not the end of the world.

Be sweet, be continual- keep going, calling with follow up questions (Columbo style)

“Don’t tell me it cannot be done, tell me how it can be done.”

“Are you aware of the great loss this will be to the county spiritually and financially if DAL moves or closes? Do you hope they leave? Are there any people that you know of here who hope this happens? This place is a great asset and blessing to our county. Please don’t drive them off with this inflexible attitude. Scores of countries have driven off their brightest and best and caused them to migrate to America just to have freedom to practice their religion. America got a lot of good people this way (including most of our ancestors) and other countries had a great “brain drain.” Escambia County needs to find a way to remedy this issue before it is too late.

If a billion dollar a year business wanted to move into this county wouldn’t you find ways to accommodate their concerns? Don’t counties make exceptions all the time by courting businesses to move in with perks like no property taxes for 10 years or cheaper electric or water rates? Florida did this to attract Disney. Why can’t the county make some simple concessions here? The church is not asking for permission to build things that are unsafe or unhealthy. They asked you to come look at their work. They just have a problem with submitting the church to Caesar.

“Have you ever seen Dr. Hovind’s tapes? Been to his seminar? Have you been to DAL?”

“Could it be that he is a man of God and the ministry there is of God and they are right?”

In general, don’t answer their questions. You are there to get information. The one asking the questions is in charge. They are the “public servants.” They work for you. Why are they being lazy in their job?

Don’t leave with them thinking you are satisfied with their answer. “Thanks for your time, I will do some more research on this. Can I have a time to meet with you this afternoon? How about tomorrow? The next day? Who else can I talk to, to get this resolved?” Remember, these people are politicians. They are often slick talkers and know how to weasel out of blame and responsibility.

The inspectors and commissioners should have so many people camping out at their office that they are afraid to visit their own office. If they are gone just say, “I’ll wait right here until they return.” Bring some school work or a book. Get to know their secretaries and keep calling. Be nice but firm. “I want to talk to them face to face.” When this is over we want them to be our friends and bring their families to DAL.

Keep a diary of who you saw, when, what was said, what was accomplished.

“I keep reading that the county says, “The buildings need to be ‘in compliance.’” What if they are “in compliance” with all the codes except the paperwork, why can’t that be fixed in some less draconian way?” The buildings have been used by tens of thousands of people for 5 years, been inspected 5 times already and stood through 3 hurricanes. Isn’t it obvious they are fine?

Do you know of any serious health or safety issues that I should be worried about? My kids go there often. The county got an inspection warrant 2 years ago and came to inspect at that time. What problems did they find?

How much time, energy and money has the county spent on this?

How much of God’s money has the Church had to spend on this?

Do you know what a hardship this closing of the buildings is on the ministry?

It was banks and insurance companies that pushed for permits years ago to be more certain the buildings they were risking their money for were not going to lose them money from shoddy construction or electrical fires. (see I Tim 6:10). The other main purpose of permits is to raise taxes. Since there is no loan on the buildings and insurance is not an issue and the buildings are Church property and non-taxable, why is this even an issue?

I can understand why permits might me needed for public property or to insure builders are honest when building for others. Why is this needed for private property? If the answer is, “to be sure it is safe if it gets sold.” Then why don’t buildings that are inspected get a special seal of approval which will notify the buyer and raise the value? Thousands of buildings in the county did not get inspected. Most pre-1975 building were not inspected at all. Do these ever sell? Many counties in America have no building permits at all. The same is true of most other countries in the world.

Is it true that your inspections department is totally funded by the permit fees and fines? Is their a financial incentive to not recognize the church as being exempt from the fees? See I Tim 6:10.

“Have you read the proposed settlement the church sent the county 4 months ago? Why didn’t they answer and what is wrong with it?”

The church has asked for a list of defects you see in their property. Where is this list?

Road Blocks to watch for:

Some officials may say, “This was done by court order and we cannot talk about it or change it.”

This is bologna! In the case of the commissioners it was their actions that caused the court order! They cannot change the court order and we are not asking them to. The court said the buildings are to be closed “until the inspections department is satisfied.” The commissioners can order their inspections department to issue a certificate of occupancy and the problem is over. The commissioners do run the county don’t they? Or they can vote to incorporate REFRA or RELUPA into the code to allow for freedom of religion and the problem is over. They can vote to exempt the Church like federal and state lands.

If they will not make an appointment to talk about it go to their office anyway! They caused this and can stop it. Don’t let them hide behind the court order!

The same type answer applies to the building inspections department. Don’t let them say they are just enforcing a court order. They asked for the court order and can issue the permit and certificate of occupancy in 3 seconds and the court order is moot!

Don’t let them get by with the run around- “It is not my job.” Yes it is. Have you done all you can to fix this? If you can’t then who can? The inspectors say the attorney told them to do this. The attorney says the court ordered it. The court says the inspectors asked for this to be done!

If they say, “The courts have ruled that they must get a permit.” I would say, so what? Court decisions get reversed all the time. They are not God. Also, I am not asking you to reverse the court decision but to solve the conflict that created the court decision. Give the Church a permit or certificate of occupancy.

The inspectors will say they are just enforcing the laws as given by the commission and the commission will say the building inspections department handles inspections. In reality, either or both could fix the problem.
