			<content:encoded><![CDATA[<p>There are several possible properties in Mississippi we are looking at for a creation camp site.  No definite plans yet but keep praying.  One great advantage of the places we are looking at is, they have no permit or inspections department.  They actually allow the church to manage its own affairs as our founding fathers intended!  If we get one of these places we will need lots of money to start building ASAP.</p>
<p>The county battle is still going but the judge has not yet reversed his order so we are set up in tents and going on with our calling to serve God.  Come visit!</p>

<p>I enjoyed the new newsletter and will keep an eye out for a camp site.  I&#8217;m sorry to hear about your son-in-law.  I had an idea about what you should do about the county permit problem.  Since the county doesn’t seem to understand the history of the church-state relationship nor do they seem willing to accommodate the sincere convictions of the church I suggest that you get the permits under duress.  This shows they are breaking the law several ways.  This will give you plenty to get them on after you get the instant problem solved.  It is illegal to obtain a signature under duress yet they have the guns and won’t hesitate to use them.   Proceeding under duress preserves your right to sue them for this clear violation of their limited jurisdiction.</p>
<p>While you are going through their process you can continue the legal process all the way to the Supreme Court.  This will cost about $60,000 total, most of which is already spent by now in the lower courts.  I will support you in this and I’m sure many more who love your ministry and freedom will support you as well.  This case needs to be taken all the way since the county has broken so many laws already.  I love the abatement you filed with the court.  That explains the problem so well.  Keep up the great work!</p>

			<content:encoded><![CDATA[<p>May 9 at 11 am is the hearing for Judge Michael Allen to reconsider his order to close the buildings.  There are at least 35 serious problems with his order.  If he does not reverse it and we appeal over his head and win, it will sure look bad on his record and may end his career as judge.  Glen Stoll’s Abatement filed last week in this case points out all the flaws in his order.  I will post it as soon as I can.</p>
<p>Please pray that God will turn his heart and that he will order the county to mediation again and open the buildings.  Everyone knows the issue is not health or safety.  The buildings have been inspected 5 times.  The only issue is control over God’s church.</p>
<p>We have located a camp to begin another DAL and will be traveling to see it for the 3<sup>rd</sup> time tomorrow.  If all works out we will need a bunch of money and work from those interested in seeing a Creation Camp where we can train the next generation of students to terrorize, I mean, correct the mistakes teachers bring up in public school classes across the world.</p>
<p>I will post a blog about the camp ASAP with a list of needs when I get back.</p>

I wonder how many of the media who have written critically about DAL would pay for a permit to write those articles? How many of us would pay for a permit to speak on the phone? How many would pay for a permit to post an item on the internet critical of Bro. Hovind? Why don’t those who oppose him have to pay for permits to do that?</p>

<p>Dear Escambia County Commissioner Whitehead,</p>
<p>I watched the channel 10 news yesterday where you said that the Church ministry at Dinosaur Adventure Land must “render to Caesar the things that are Caesar’s, and right now Caesar demands a building permit.  If they don’t get one, we may have to tear the buildings down.”</p>
<p>It always amazes me how people like you quote half a verse out of context to prove their point.  The rest of the verse is never quoted.  Matthew 22:21 “They say unto him, Caesar&#8217;s. Then saith he unto them, Render therefore unto Caesar the things which are Caesar&#8217;s; <strong>and unto God the things that are God&#8217;s.”</strong>  The Church is not Caesars!  Also Mark 12:17, Luke 20:25.</p>
<p>There are a few things you seem to forget:</p>
<ol>
<li>The Church ministry you are referring to is not a      501-c-3 corporation of the state.</li>
<li>No churches in the county got permits of any kind      for hundreds of years.</li>
<li>They have invited you out many times to inspect      for safety and health yet you don’t come.</li>
<li>They have had licensed engineers and electricians      inspect the buildings.</li>
<li>They have been open for 5 years without problem</li>
<li>They stood through three hurricanes with no      damage while your own building was damaged badly.</li>
<li>Dictators down through history have “won” battles      with those who oppose them.  Hitler      “won” over the Jews.  Stalin “won”      over the Christians in Russia, the catholic church “won” over the millions of      Christians they killed, OJ “won” his court battle.  Don&#8217;t think because you &#8220;won&#8221; in court that proves you are right.</li>
</ol>
<p>Have you prayed about what you are doing?  Please do not hide behind a court order or directions from the attorney.  Please don’t tell me you are just obeying orders, Hitler’s men said the same thing at their trial.  You claim to be a Christian and I believe you are but please just answer these two questions, Have you prayed about what you are doing, and do you feel God has led you in your decision?</p>

			<content:encoded><![CDATA[<p>When I read the Pensacola News Journal article April 7, 06 “Park could face extinction” by William Rabb I couldn’t help but wonder, “Are these people morons or just desperate to sell papers?”  The recent court ruling to close a few of our buildings over the permit issue (which has been going on for 5 years) does not close our ministry or even our Dinosaur Adventure Land.  We still have lots of visitors coming every day.  Remedies at Law, the managers of the ministry, are working with the courts and county to reopen the buildings and I still travel every week doing seminars on creation, our bookstore is still open, we still ship out thousands of books and videos every week, I still do my daily radio program on www.truthradio.com from 4:30-6 pm CST and souls are still being saved and lives changed.  We are no where near “extinction.”  They must be desperate or dense!</p>
<p>Another rumor is that I want to be a law unto myself and not get the county building permits.  First, this is a ministry wide decision and Glen Stoll, the manager, makes those calls.  I travel too much to spend much time on this.  Second, the county has inspected the buildings twice, as well as two state certified engineers and two state certified electricians.  The issue has never been one of safety or health.  We have filled out the papers and given the county the information they requested 2 ½ years ago and never got a response, other than locking the buildings.  We have repeatedly asked them what they want from us and we get no response.</p>
<p>Escambia County Commission Chairman Mike Whitehead did exactly what Satan did in Matthew 4:6 by quoting half a verse.  At the hearing last Thursday Mr. Whitehead said “Render unto Caesar the things which are Caesar&#8217;s. And right now Caesar demands a building permit.”  He does not understand the rest of the verse.  Matthew 22:21 “They say unto him, Caesar&#8217;s. Then saith he unto them, Render therefore unto Caesar the things which are Caesar&#8217;s; <strong>and unto God the things that are God&#8217;s.”</strong></p>
<p>The Church is not Caesar’s!  We are willing to be good neighbors, let them inspect and make suggestions, we have invited them many times to do this.  The only issue is control.</p>
<p>Before you believe and repeat things about our ministry in violation of Exodus 20:16 “Thou shalt not bear false witness against thy neighbour.” Call in to our radio program and ask any questions you want.  In America you still get to face your accusers and are innocent until proven guilty.  At least it is supposed to be that way.</p>

<p>“Why can’t they just submit?”  That is what Nebuchadnezzar was thinking as he ordered the Hebrew children thrown into the furnace. They were loyal top officers in the kingdom.  They just served a bigger God.  That’s why they couldn’t submit.</p>
<p>Why can’t they just submit?  That’s what the Romans were wondering as they rounded up Christians by the thousands and crucified them for disobeying the Roman laws about claiming there was an authority over Caesar.  How dare they insult “his royal highness” so!  Don’t they know that Caesar is God?  We’ll teach them!  Why can’t they just submit?”</p>
<p>Why can’t they just submit? That’s what the Inquisition officers said as they tortured and murdered millions of Christians who dared to claim the Pope was a sinner like everyone else or that Marry was not a “perpetual virgin” or that the bread did not actually become the body of Jesus so the priest controlled God as he held the wafer.  Don’t they know that our law says they must believe this?  Why can’t they just submit?”</p>
<p>Why can’t they just submit?  That’s what the kings of Europe wondered as they hounded the Pilgrims for daring to teach that baptism was only for believers.  “Don’t they know we have met and decided that infant baptism is all that is needed and to re-baptize is against the law?  How many of these Anna-Baptists will we have to kill and confiscate their lands until they understand?  Why can’t they just submit?”</p>
<p>Why can’t they just submit? That’s what King George thought as he sent his army to snuff out the “rebellion” among the colonies who dared to ask that they be represented in the decision making process.  “It is only a 1% tax on the tea.  Just pay the tax and shut up!  Why can’t they just submit?”</p>
<p>Why can’t they just submit?  That’s what the elected officials in Culpepper,  Virginia said as they whipped 12 Baptist pastors to death in 1775 for refusing to take a license to preach in their county.  Why can’t they just submit?  (See the story on drdino.com/patrick)</p>
<p>Why can’t they just submit?  That’s what communist dictators said for 70 years as they jailed, tortured, killed or exiled millions of Christians in China and Russia who did not obey the state laws about only meeting in “state approved” churches where sermons were pre-approved and political dissent was silenced by force.  “Don’t these people know we have the guns and will kill them if they disobey?  Why can’t they just submit?”</p>
<p>“Why can’t they just submit?”  That is what Building inspector Don Mayo, Attorney Allison Rogers, Attorney Janet Lander, George Touart, Commissioners Kevin White, Tom Banjanin, Marie Young, Bill Dickson and Mike Whitehead are asking themselves right now.  “Don’t these people know the courts have ruled, the commission has voted, the inspectors have decided?  They must get our permission to operate a Church ministry in this county.  We decide if they can have a church ministry on that property and we decide if they build their buildings to worship God in the correct way.  We decide who is allowed to worship God here and where they can do it.  People like Apostle Paul, Patrick Henry, Shadrach or John Bunyon are not welcome here.  Why can’t they just submit?”</p>
<p>So&#8230; Why can’t the Church ministry at 29   Cummings Road in Pensacola just submit?  I can’t explain it to them.  I’ve tried but they will not or cannot listen.  Maybe someone else can explain it to them.  Maybe God will have to explain it to them!  [Job 38:1 style?] We don’t want to cause problems.  We don’t want to build anything unsafe or pollute the ground or bother our neighbors.  We have begged them to come tell us what they don’t like about our buildings but they won’t tell us.  I fear that this county is at the crossroads and their decisions in the next few weeks or months may result in God’s blessing or judgment.  Deut. 11:26.</p>
<p>When people are given a badge and a gun or a black robe, does it always make them think they are God?</p>
<p>Proverbs 30:21 “For three <em>things</em> the earth is disquieted, and for four <em>which</em> it cannot bear: For <strong>a servant when he reigneth;”</strong>  “Don’t they realize there is a higher power named God?  Why can’t <strong>they</strong> (the county) just submit to God?”</p>

I&#8217;ll write more later but I think these people need your prayers, calls, letters and visits (if you can&#8217;t get them at the office you may catch them at home) to have God change their heart and stop persecuting the ministry (see Dr. Hovind&#8217;s previous blogs)</p>
<p>Keep in mind these people below started this fight, can end it and have not been helping solve the problem at all.  If they seem irritated when you call, good!  They have hurt God&#8217;s man and God&#8217;s Church and they should be flooded with calls and letters.  Make em do right!  Roll Tide!</p>

<p>If I had not seen it myself I would not have believed it!  I thought the lady was going to blow a gasket!  Well, let’s start at the beginning.  For those who have followed the story of the permit battle between our ministry and the county for the last 5 years, this will make more sense.</p>
<p>Today, Glen Stoll, Bruce Craig (both managers of our ministry) and I went to the Escambia County Commissioners offices to try to talk with them about resolving the conflict peacefully.  All five commissioners were gone, as well as most secretaries but the two that were there told us that the county attorney, Janet Landers had instructed them to not talk with us, we could only talk with her about the case.  Janet Landers was in a meeting at the time so… we went up to her office to ask her secretary when we could get an appointment.</p>
<p>As we were talking with her an extremely irate woman came out of a room down the hall and said, (very loudly) “You need to get out of this building immediately!”  I was shocked, stunned and surprised at this outburst so I looked around to see who she was talking to.  When she repeated it I said, “Are you talking to us?”  She said, “Yes, you must leave this building now or I will call security.”  I said, “What for?  We are not causing any problems.  We just came to make an appointment with Janet Landers.”  She said, “I am Janet Landers and I am ordering you to leave this building!”  I said, “Ma&#8217;am, I believe this is a public building and we just came to talk with you. What have we done wrong?”  As she came over menacingly and held the door open I thought she was going to push us outside.  I had never met her before and my first impression will take a while to overcome!</p>
<p>Understanding that Proverbs 22:24 “Make no friendship with an angry man; and with a furious man thou shalt not go:” probably applies to women also, I felt led of the Lord to leave.  We went downstairs to get the county charter only to discover that Escambia County does not have a charter-so what exactly is their legal right to exist based on?  As we were asking the clerk a few questions I noticed two Escambia County Deputies walking in the door at the end of the hall like they were looking for someone.  As I was walking out to drive home for my radio program, one of the secretaries from upstairs came franticly running up to the police officers and said, “They are over there!” Pointing at the room we were in.  I waved and said, “It’s OK ma&#8217;am, we are not hurting anybody.”</p>
<p>Imagine!  Being arrested for trespassing in a public building for just asking questions!  What a strange county.  None of us were arrested but it felt like the Soviet Union for a few tense moments there.<br />
As I drove back and even now, seven hours later, I cannot figure out what would trigger such a violent reaction from Janet Landers.  The county started this battle against the Church five years ago.  We have tried to be nice in every way possible.  (Romans 12:18) We dropped all law suits against them, met with them several times, sent lots of letters and invited them out to inspect many times, yet the situation seems to be worse not better.</p>
<p>Here are my thoughts so far.</p>
<p>1. The county is hiding something they don’t want uncovered.  Four of the last five commissioners were arrested (on non-related issues) several months after they voted to persecute us.  (This new group of commissioners and lawyers going after us need to read Ps. 105:15 quickly!)</p>
<p>2. Someone in high places in the county hates God’s Kingdom on earth.  (nothing new there!)</p>
<p>3. They fear we will sue them for all the countless violations they have committed like: A. none of them having an oath of office as required by law when they started attacking our Church and the law saying they cannot get paid until they have this oath on file.  (Imagine if they all had to pay back everything they have gotten from the county for all those years!)  See US Constitution- Article 6 Clause 3 and Florida State Constitution, Article 2 SECTION 5.b and Florida Statute 876.05 (2)  “Said oath shall be filed with the records of the governing official or employing governmental agency prior to the approval of any voucher for the payment of salary, expenses, or other compensation.”  876.06-9 show the nasty things that should be done to the ones who took the money (and the ones who paid it out) for this one!  Or B. them not having the proper parties served when the buildings were ordered closed by force or C. or D. or E …  We have quite a list to call upon if need be.</p>
<p>4. Maybe they are worried that the courts farther up the food chain (outside this county or state) will not be part of their “good ol boys club” and decide to clean up the cesspool we seem to have stepped in.</p>
<p>We don’t want to fight these people.  We want to build God’s Kingdom by winning souls and influencing them to live for Him.  All the kingdoms of this world (including the little Escambia County kingdom) will be carried away like chaff one day (see Daniel 2:35) when Christ sets up His Kingdom.  That’s the one I want to work for!</p>
<p>Please pray that they will leave us alone, reverse their orders, drop their charges, pay the damages they have caused, hook up our utilities and come visit the greatest creation ministry on earth (in our humble, unbiased opinion).   Based on what I saw today I would say the Lord is working on them!</p>
<p>There is an open to the public meeting of the commissioners every 1<sup>st</sup> and 3<sup>rd</sup> Thursday from 4:30- ???.  Anyone can speak their mind.  Please attend this week if you can and show your support for the Lord’s work and please, keep praying for God to work on these people.  They need to be getting thousands of calls, letters and emails from God fearing people.  Read Esther 4:4.  (I just noticed today’s date is 4-4!)  And above all, pray for God to get their attention!<br />

			<content:encoded><![CDATA[<p>What an awesome funeral for my son-in-law, Paul!  Hundreds came to share what his life and testimony ment to them.  I flew in Sunday morning after a great Sat. night meeting at Oak Grove High School in MO.  I shared a quick history history of how my daughter and Paul met, then they played an incredible video of Paul&#8217;s life put together by my son Eric.  Paul&#8217;s dad brought the message.  That must be the hardest thing for a man to do!  The entire service is soon to be available for those who are interested.  There is a fund in Paul&#8217;s name to help people adopt children.  If you make a donation in any amount and request the funeral service we will send it to you.</p>
<p>The county battle is still going strong.  We never wanted this battle.  We just want to serve God and be left alone.  There is a long history of conflict between God&#8217;s people and secular authority over the Lordship of Jesus. It seems it will never end.  If you would like to help, the county commissioners can use lots of &#8220;encouragement&#8221; to solve this problem that they created.</p>

<p><strong>April 3, 2006</strong></p>
<p align="center"><strong>For those following the 5 year conflict between Escambia County and the Church we thought it would be good to spell out, What does Dinosaur Adventure Land (DAL) want from the county and who can give it to them?</strong></p>
<p>For nearly 2000 years it has been the sincerely held religious conviction of Christians that Jesus, not Caesar, is the head of the church. Colossians 1:18 “And he is the head of the body, the church: who is the beginning, the firstborn from the dead; that in all <em>things</em> he might have the preeminence.”</p>
<p>Since Jesus founded it, the Lord’s church has also attempted to stay separate from entanglement with government.  This has led to great conflict and persecution of the Church by those who think Caesar is lord over all.  See <em>Foxes Book of Martyrs</em>.  Conflicts between the Church and government officials are recorded in 21 out of 28 chapters in the book of Acts.  Most of the early settlers of this county fled here in order to have religious freedom from the state controlled churches in Europe.  The founding fathers made the “separation of church and state” doctrine very clear in scores of their writings over 230 years ago.  They taught that the state has no jurisdiction over the Lord’s church.</p>
<p>In addition to the clear commands of God’s Word and Article 1 of the US Constitution, Florida Statue Chapter 761, the <em>Religious Freedom Restoration Act of 1998</em> (RFRA) clearly tells us that “The government shall not substantially burden a person&#8217;s exercise of religion,” 761.03 “&#8221;Exercise of religion&#8221; means <strong>an act or refusal to act</strong> that is substantially motivated by a religious belief,” 761.02 (see below)</p>
<p>The law says a Church can act or <strong>not act</strong> based on our religious convictions. In the fall of 2000 we built a small metal building to hold ministry services in and to teach and train people about the biblical account of creation.  Our pastor did not ask the county for “permission” to build on the Lord’s property as this would be an admission that the Church is subject to Caesar.</p>
<p>On March 29, 2001 two Escambia County building inspectors came unannounced and uninvited and trespassed on the clearly marked Church property to issue a citation.  Soon thereafter the county commissioners voted to fund the legal battle that ensued and continues today.  The county has spent hundreds of thousands of dollars so far and still, no end is in sight.</p>
<p>We understand that in the last 100 years many churches have become “incorporated” as 501 c-3 organizations, which makes them creatures of the state, and therefore subject to permits.  Our ministry is not one of those and this is the distinction many people in the county are missing.</p>
<p>Millions of Christians in the early centuries faced torture and death rather than submit the Lord’s church to Caesar.  These martyrs were not lawless people looking to be defiant of God ordained governments and neither are we.  We answer to a much higher authority, that of the Creator of the universe.</p>
<p>We pay to have our buildings engineered and inspected by professionals to insure the safety of those we minister to.  We understand the importance of this.  We are even willing to pay the county inspectors to come inspect them.  Our buildings are safe in all aspects that the county may have concerns over.  Obviously there are hundreds of buildings standing in the county today that did not get Escambia County’s permits, such as those on the Navy base, State of Florida lands or those buildings built before the inspections department was created in the 70’s.</p>
<p>We are a peace loving people who simply wish to serve the Lord.  We have sincerely held religious convictions against the church being taxed (permit fees) as well as asking others for permission to do what God has called us to do.  Once jurisdiction is granted in one area, where does it stop?  Those who live under communist control know that it does not! The Amish across the country, including Florida, object to (and do not obtain) building permits for similar religious reasons and Disneyland in Florida never gets county permits. <p>Escambia County Commissioners have taken an oath to uphold the constitution where this principle of separation is enshrined in the first amendment.  We feel sure that they all know the value of having churches and ministries training people in our county to love and obey the Lord.  Surely this is much cheaper that the jail system we all support for those who do not obey the Lord’s commands.  Ministries like ours are an asset to the county.</p>
<p>We know that our little ministry on 6 acres is not of great concern to some but we think God cares and is watching closely.  The current commission has the power to resolve this ongoing conflict today as well as prevent future problems and expenses for both our ministry and this county.</p>
<p>The only people who stand to gain from prolonging this conflict are the attorneys who get paid by the hour and love this stuff!   Our ministry fears that this struggle (which may have to go all the way to the Supreme Court) is sure to bring much negative publicity for our county.  We would love to see this resolved peacefully so we can devote more time to preaching God’s Word.  All our ministry wants to do is serve the Lord and influence others to do the same.  We want to live peaceably with all men as commanded by the Lord and be a blessing to this community.</p>
<p><strong>The solution</strong> is quite simple as we see it.  It seems to us that the prudent thing for this commission to do is to vote to incorporate RFRA into the local building codes and end the conflict now.</p>
<p>This board of commissioners needs to require their inspectors to abide by existing Florida law (RFRA) or vote to incorporate the <em>Religious Freedoms Restoration Act</em> into the building code of Escambia County as other counties in Florida are doing even now.  This action would resolve this current dispute with the Church ministry at 29   Cummings Road as well as prevent future challenges, which are sure to come as RFRA becomes more well known.</p>
<p>We feel the section below or something similar, would help the county building code incorporate RFRA.  (This was proposed to the commission several years ago with no reaction.  Since it is now election year they may be listening better.)</p>
<h1>Statement of Finding by the Escambia County  Commission, Escambia</h1>
<p align="center">The Escambia County Board of County Commissioners acknowledges the lawful existence of, and our intention to comply with the Florida Statue Chapter 761, the Religious Freedom Restoration Act of 1998 (RFRA). We further find that the county can be spared countless legal challenges to its building, zoning and development regulations by taking the prudent action of incorporating RFRA into our own county building code and related ordinances.  We recognize that by statute RFRA already applies to the FLORIDA BUILDING CODE and that our action makes clear our desire to comply with RFRA/Florida Statute Chapter 761.</p>
<p align="center">
<p align="center"><strong>County Ordinance </strong><!--[if supportFields]&amp;amp;amp;gt; SEQ CHAPTER \h \r 1--><!--[if supportFields]&amp;amp;amp;gt;--><strong>Sec. ## &#8211; ##.  Compliance with Chapter 761.</strong></p>
<p align="center">NOW THEREFORE BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF ESCAMBIA COUNTY, FLORIDA</p>
<p>“Enforcement of this ordinance will be in strict compliance with the provisions of Florida Statue Chapter 761, the Religious Freedom Restoration Act of 1998 (RFRA).  The Building Department, Code Enforcement Department, County Administrator, and any other such county officials or departments as may regulate, enforce, and/or administer the provisions of the unified FLORIDA BUILDING CODE ACT OF 1998 (in effect statewide March 1, 2002), are hereby authorized and directed to adhere to the provisions of Chapter 761.</p>
<p>Department administrators are to direct their staff to use the least restrictive means available to satisfy any compelling governmental interest in furtherance of the county’s health, safety and welfare objectives as set forth in this ordinance.  Such authority includes making such accommodations as may reasonably be necessary, (including waiving technical requirements of the ordinance), to comply with the RFRA so long as any accommodation does not compromise any compelling interest in protecting health, safety and welfare the county may have.”</p>
<p>After voting the above ordinance into law we would like this board and/or the building department to do the following:</p>
<ol>
<li>Notify Judge Michael Allen that our ministry has met the      requirements of the law and a conflict no longer exists and his order to      close the buildings should be withdrawn and our bond returned.</li>
<li>Notify the utility companies that they should hook up our      utilities.</li>
<li>Vote to pay some of the costs we have incurred over the last five      years defending our ministry in court.</li>
<li>Come visit our unique ministry and bring your families.</li>
</ol>
<p align="center"><strong>CHAPTER 761 </strong></p>
<p align="center"><strong>FLORIDA</strong><strong> RELIGIOUS FREEDOM (RFRA)</strong></p>
<p>761.01 Short title.</p>
<p>761.02 Definitions.</p>
<p>761.03 Free exercise of religion protected.</p>
<p>761.04 Attorney&#8217;s fees and costs.</p>
<p>761.05 Applicability; construction.</p>
<p>761.01 Short title.&#8211;This act may be cited as the &#8220;Religious Freedom Restoration Act of 1998.&#8221;</p>
<p>761.02 Definitions.&#8211;As used in this act:</p>
<p>(1) &#8220;Government&#8221; or &#8220;state&#8221; includes any branch, department, agency, instrumentality, or official or other person acting under color of law of the state, a county, special district, municipality, or any other subdivision of the state.</p>
<p>(2) &#8220;Demonstrates&#8221; means to meet the burden of going forward with the evidence and of persuasion.</p>
<p>(3) &#8220;Exercise of religion&#8221; means <strong>an act or refusal to act</strong> that is substantially motivated by a religious belief, whether or not the religious exercise is compulsory or central to a larger system of religious belief.</p>
<p>761.03 Free exercise of religion protected.&#8211;</p>
<p>(1) The government shall not substantially burden a person&#8217;s exercise of religion, even if the burden results from a rule of general applicability, except that government may substantially burden a person&#8217;s exercise of religion only if it demonstrates that application of the burden to the person:</p>
<p>(a) Is in furtherance of a compelling governmental interest; and</p>
<p>(b) Is the least restrictive means of furthering that compelling governmental interest.</p>
<p>(2) A person whose religious exercise has been burdened in violation of this section may assert that violation as a claim or defense in a judicial proceeding and obtain appropriate relief.</p>
<p>761.04 Attorney&#8217;s fees and costs.&#8211;The prevailing plaintiff in any action or proceeding to enforce a provision of this act is entitled to reasonable attorney&#8217;s fees and costs to be paid by the government.</p>
<p>761.05 Applicability; construction.&#8211;</p>
<p>(1) This act applies to all state law, and the implementation of that law, whether statutory or otherwise, and whether adopted before or after the enactment of this act.</p>
<p>(2) State law adopted after the date of the enactment of this act is subject to this act unless such law explicitly excludes such application by reference to this act.</p>
<p>(3) Nothing in this act shall be construed to authorize the government to burden any religious belief.</p>
<p>(4) Nothing in this act shall be construed to circumvent the provisions of chapter 893.</p>
<p>(5) Nothing in this act shall be construed to affect, interpret, or in any way address that portion of s.3, Art. I of the State Constitution prohibiting laws respecting the establishment of religion.</p>
<p>(6) Nothing in this act shall create any rights by an employee against an employer if the employer is not a governmental agency.</p>
<p>(7) Nothing in this act shall be construed to affect, interpret, or in any way address that portion of s. 3, Art. I of the State Constitution and the First Amendment to the Constitution of the United   States respecting the establishment of religion. This act shall not be construed to permit any practice prohibited by those provisions.</p>
<p align="center"><strong>The </strong><strong>Mission</strong><strong> of the building inspections department:</strong></p>
<p align="center">“To safeguard the health, safety, and welfare of Escambia County residents, businesses, and visitors by conducting plan checking and inspection services to ensure the integrity of all new structures and major improvements to existing structures built in the unincorporated area of the County, to ensure all residential and commercial construction is in compliance with State and local building requirements, and to facilitate completion of new development applications and provide for the issuance of building permits within the unincorporated area of the County.”</p>
<p><strong><em> </em></strong></p>
<p>Note: A Church ministry is not a “residence” nor “commercial” nor a “business.”  The Church ministry at 29 Cummings has consistently challenged the jurisdiction of the inspections department and has yet to receive a response to this challenge.  When challenged, jurisdiction must first be established.  The county has never done this.</p>
<p>The inspectors probably honestly feel bound by the law to close our ministry.  The commissioners probably feel the same way.  This proposed solution solves it for everyone.  Please write, email and call them often to ask them to vote this in soon.  They meet the 1<sup>st</sup> and 3<sup>rd</sup> Thursday of the month at 4:30 for a public forum.
